General Conditions of Sale

These General Conditions of Sale (hereinafter “CGV”) govern the contractual relations between the company ATHEXIS TECHNOLOGY (hereinafter “the Seller”) and any natural or legal person making a purchase via the website https://brico-tech.com (hereinafter “the Site”).
Any order placed on the Site implies unreserved acceptance of these General Terms and Conditions.
Article 1: Subject
The purpose of these General Terms and Conditions is to define the rights and obligations of the parties in the context of the online sale of products offered by the Seller.
Article 2: Products
The products offered for sale are those appearing on the Site on the day of consultation by the Customer, within the limits of available stocks.
The photographs and descriptions of the products are provided for information purposes only and have no contractual value. Minor differences in presentation, color or packaging may exist depending on batches or manufacturers.
Article 3: Price
Prices are indicated in euros, all taxes included (TTC), excluding delivery costs.
Delivery costs are specified before validation of the order.
The Seller reserves the right to modify its prices at any time. However, the products are invoiced on the basis of the prices in force at the time of validation of the order.
Article 4: Order
The order is validated once payment has been accepted by the banking organization.
The Seller reserves the right to refuse or cancel any order in the event of a dispute with the Customer or suspicion of fraud.
Article 5: Payment
Payment for purchases can be made by credit card or by any other means of payment offered on the Site.
Payments are secured via protocols that comply with current security standards.
Article 6: Delivery
Orders are shipped to the address indicated by the Customer when ordering.
Delivery times are indicated as an indication when choosing the delivery method.
In accordance with article L216-1 of the Consumer Code, the seller delivers the goods on the date or within the period indicated to the Customer when ordering.
In the absence of specific indication,delivery takes place no later than 30 days after validation of the order.
The seller remains responsible for the proper execution of the delivery until the package is handed over to the Customer.
Article 7: Right of withdrawal
In accordance with article L221-18 of the Consumer Code, the Customer has a period of fourteen (14) days from receipt of the product to exercise their right of withdrawal.
The Customer must return the products in their original condition, complete and unused.
Return costs remain the responsibility of the Customer unless the product delivered is non-compliant or defective.
The refund is made by the same means of payment as that used when ordering, unless expressly agreed by the Customer for a refund in the form of a credit.
Article 8: Return procedure
Any product return must be requested in advance from customer service in order to obtain return instructions.
Returned products must be properly protected and sent to the address indicated by customer service.
Article 9: Legal guarantees
The products sold benefit from the legal guarantee of conformity provided for in articles L217-3 et seq. of the Consumer Code as well as the guarantee against hidden defects provided for in articles 1641 et seq. of the Civil Code.
The consumer has a period of two years from delivery of the goods to obtain implementation of the legal guarantee of conformity in the event of a lack of conformity appearing.
The legal guarantee of conformity applies independently of any commercial guarantee that may be granted.
In the event of a lack of conformity, the Customer may request repair or replacement of the product in accordance with legal provisions.
Article 9.1: Sensitive products and electronic spare parts
The electronic spare parts sold on the Site, in particular screens, cameras, batteries and other internal components, are sensitive products requiring special precautions during their handling and installation.
The Customer is responsible for the assembly and installation of the purchased product. The Seller cannot be held responsible for damage resulting from improper handling, incorrect assembly or use of unsuitable tools.
Article 9.2: Product testing before installation
It is strongly recommended to test the product before final installation. For screens and electronic components, the test must be carried out before any complete assembly or gluing of the component.
Once the product is installed, glued, soldered or permanently integrated into the device, it is considered used.
Article 9.3: Protective films and warranty labels
Some products are delivered with protective films or warranty labels to verify that the product has not been permanently installed.
Removal of the protective film or deterioration of a guarantee label may prevent the return of the product under the right of withdrawal, except in the event of a proven defect in the product.
Article 9.4: Products damaged during assembly
Any product showing traces of assembly, excessive handling, breakage, scratches or damage linked to installation cannot be considered defective.
In this case, the product cannot be exchanged or refunded, except within the framework of the legal guarantees provided for by the regulations in force.
Article 10: Liability
The Seller cannot be held responsible for damage resulting from improper use of the purchased product.
The Seller cannot be held liable for indirect damage resulting from the use of the Site or the products sold.
Article 11: Intellectual property
All elements of the Site (texts, images, logos, graphics, etc.) are protected by the provisions relating to intellectual property.
Any reproduction or exploitation without prior authorization is prohibited.
Article 12: Personal data
The personal data collected is processed in accordance with the General Data Protection Regulation (GDPR).
The Customer has the right to access, rectify, oppose and delete personal data concerning him.

Article 13: Dispute settlement
These General Terms and Conditions are subject to French law.
In the event of a dispute, the Customer is invited to contact customer service in order to find an amicable solution.
In accordance with the provisions of the Consumer Code relating to mediation, the Customer may use the following mediator free of charge:

In the absence of an amicable resolution, the dispute may be brought before the competent courts in accordance with the rules of common law.
