General Terms of Use (GTU)

These General Terms of Use (hereinafter the "GTU") legally govern the use of the site https://brico-tech.com (hereinafter the "Site") and the services provided by the company ATHEXIS TECHNOLOGY (hereinafter the "Publisher").
Access to the Site and its use imply the full and unreserved acceptance of these GTU by the User. The User undertakes to comply with them. These T&Cs are accessible at any time on the Site in the "General Terms and Conditions of Use" section.
Article 1: Access to the Site
The Site is accessible free of charge to any User with Internet access. All costs relating to access to the Site, whether hardware, software or Internet access costs, are the sole responsibility of the User.
The Publisher strives to make the Site accessible 24 hours a day, 7 days a week, except in cases of force majeure or an event beyond the Publisher's control, and subject to any breakdowns and maintenance work necessary for the proper functioning of the Site and services.
The Publisher shall not be held liable for any damage, whatever its nature, resulting from the unavailability of the Site or part of it.
Article 2: Registration on the Site
Access to certain services may require the creation of a User account. The User undertakes to provide accurate and complete information when registering and to update it in the event of a change.
The User is solely responsible for the confidentiality of his or her login details. In the event of loss or unauthorized use of his or her account, he or she must immediately inform the Publisher. The Publisher shall not be held liable for any fraudulent use of the User account.
Article 3: Site Services
The Site offers the following services in particular:
- Sale of spare parts and accessories for iPhone, iPad, Apple Watch, MacBook, and Samsung.
- Order tracking and customer account management.
The Publisher reserves the right to modify, suspend or delete all or part of the services at any time, without notice,and without this giving rise to any right to compensation for the User.
Article 4: Intellectual Property
All elements of the Site (texts, images, videos, logos, graphics, icons, sounds, software, etc.) are protected by copyright, trademark law and patent law. They are the exclusive property of the Publisher or its partners.
Any reproduction, representation, modification, publication, transmission, distortion, total or partial of the Site or its content, by any process whatsoever, and on any medium whatsoever, is strictly prohibited without the prior written consent of the Publisher. Any unauthorized use of the Site or its content engages the responsibility of the User and may result in legal proceedings.
Article 5: Personal Data
The Publisher assures the User that personal data will be collected and processed in a manner that respects privacy in accordance with current legislation, in particular Law No. 78-17 of January 6, 1978 relating to information technology, files and freedoms, and Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 (GDPR).
The personal data collected is necessary for order management, service improvement, and may be used for commercial prospecting purposes. The User has the right to access, rectify, delete and oppose their data. He may exercise this right by contacting the Publisher at the following address: support@brico-tech.com.
Article 6: Liability
The Publisher strives to provide accurate and up-to-date information on the Site. However, the Publisher cannot guarantee the accuracy, completeness or timeliness of the information published on the Site. The Publisher cannot be held liable in the event of errors or omissions.
The User is solely responsible for the use he makes of the information made available on the Site. The User is also responsible for the security of his computer equipment and personal data when accessing the Site. The Publisher cannot be held liable for any direct or indirect damage resulting from the use of the Site or its content.
Article 7: Hypertext Links
The Site may contain hypertext links pointing to external sites. The Publisher has no control over these sites and declines all responsibility for their content. Access to these external sites is under the sole responsibility of the User.
Article 8: Modification of the T&Cs
The Publisher reserves the right to modify these T&Cs at any time in order to adapt them to legislative, regulatory or technical developments. The modifications made will be binding on the User as soon as they are posted online. The User is therefore recommended to consult the T&Cs regularly.
Article 9: Applicable Law and Competent Jurisdiction
These T&Cs are subject to French law. In the event of a dispute not resolved amicably, the competent courts will be those within the jurisdiction of the Court of Appeal of Avignon , unless otherwise required.
